with the Prosecution’s closing.  It was brilliant and concise.  Attorney Schleicher put a human face on George Floyd while putting a demonic face on Chauvin.  He adeptly pre-demolished the defense’s I hope you had a restful weekend.  I’m not sure if I could if I were on the jury.  I don’t know MN law, but generally there are no time limits, other than those self-imposed, on closing arguments.  The prosecution had far more witnesses but had a memorable progression for when they testified and how testimony built for reinforcement.  The defense, on the other hand, had dreadful witnesses with a hodgepodge of testimony culminating in two unimpressive “experts.”  When I write, unimpressive, I am not speaking to credentials; rather, their testimony and demeanor. The prosecution is also allowed time for rebuttal after the defense’s conclusion.  The defense is not provided the same opportunity. MDT, and 7:15 PDT — or earlier if the Judge wants a chat with the attorneys. Welp, what can I say about yesterday’s expert, retired MD medical examiner, David Fowler?  Not a damned thing good.  He came across as arrogant even on direct; squirmy and angry on cross.  He spoke in medical terms that were beyond the normal grasp of most of us mere mortals — and this jury has had an introduction to many difficult terms.  The jury has had the benefit of prosecution experts who immediately translated into plain American words. The latest cause of death or contributing cause at least is carbon monoxide from huffing the squad car tail pipe.  Ignore the fact that Mr. Floyd displayed no symptoms nor was there any evidence in the toxicology report.  According to Fowler, Mr. Floyd died from everything except Chauvin and two other cops crushing him into the pavement. His testimony requires the prosecution to call at least one rebuttal witness since David Fowler, minister to dead people, assumed the roles of pulmonologist and toxicologist without any special training.  We have at least one witness today then we’ll see where we go from there.  I’m sure the prosecution’s experts have been following the defense’s direct examination and are prepared to fly back from wherever they are but that may require a bit of leeway.  There is a potential we will use up Friday on witnesses. of the hour to see if there’s anymore house keeping.  The judge dealt with several video issues at the end of the day yesterday. All I can say is, gird your loins.  If today is anything like yesterday, have some extra strength Excedrin and a bottle of scotch at your elbow.  Yesterday’s witnesses were as follows:  retired cop Scott Creighton — not helpful; retired paramedic Michelle Mosing — not helpful; Shawana Hill — not helpful; Park Police Officer Peter Chang — not helpful; MPD medical trainer Nicole McKenzie — not helpful; use of force “expert” — really, really, really not helpful.  I did consider them all helpful to the prosecution.  Cross examination is a dangerous thing.  I addressed the first five in my afternoon diary, <a href="https://www.dailykos.com/stories/2021/4/13/2025717/-Liveblog-II-Day-12-of-the-Chauvin-Murder-Trial" target="_blank">Liveblog II: Day 12 The Chauvin Murder Trial</a>.  The use of force guy is impossible to describe so please read and rec Lauren Floyd’s <a href="https://www.dailykos.com/stories/2021/4/13/2025763/-Defense-expert-claims-George-Floyd-should-have-been-resting-comfortably-with-knee-on-his-neck#comment_80722522" target="_blank">Defense expert claims George Floyd should have been 'resting comfortably' with knee on his neck</a>.  Her roundup diaries are consistently excellent and supplemented by video.  Yes, he said that and other shite.  Cold, unemotional, never looked at the jury once.  Also I recommend reading  WaPo’s Robin Givhan’s “Perspective” <a href="https://www.washingtonpost.com/nation/2021/04/13/objective-reasonableness-fear/" target="_blank">The objective reasonableness of fear:  Chauvin’s defense team used this key ingredient to justify use of force</a>. I’m not sure if the defense’s “expert” Medical Examiner will be on today but this factoid will be of interest in cross examination:  <a href="https://www.washingtonpost.com/nation/2021/04/13/chauvin-trial-expert-maryland-medical-examiner/" target="_blank">Derek Chauvin’s witnesses include former Maryland medical examiner being sued over ‘chillingly similar’ case</a>.  Three white cops and a white civilian pinned Anton Black to the ground.  He died.  MD Medical Examiner David Fowler. <blockquote> <div style="text-align:start"> A report signed by Fowler and an assistant medical examiner deemed Black’s <a href="https://www.washingtonpost.com/local/public-safety/medical-examiner-rules-death-of-19-year-old-black-man-in-police-custody-an-accident/2019/01/24/fe014984-1ff5-11e9-8b59-0a28f2191131_story.html?itid=lk_inline_manual_32" target="_blank">manner of death to be an accident</a>. Morning session had some house cleaning regarding admission of video from the Park Police Officer.  Judge ordered admissible in part — redact footage of Chang looking at computer screen in his vehicle and any footage after Fire Rescue leaves. Next witness was Shawana Hill who was in Cup Foods and the vehicle Floyd was driving.  Her big contribution was that Floyd, after telling her he was tired from working long hours, fell asleep in the vehicle and was hard to wake — but became immediately alert, put his hands on the steering wheel when the cops approached with guns drawn.  She definitely didn’t want to be there. Next witness was Park Police Officer Peter Chang.  He was there to authenticate his body camera footage.  If you were interested in video of his drive from the park to Cup Foods (a few minutes), his putting on his siren and lights and then shutting them off prior to hearing the Code 4 (scene secure), parking his car, crossing the street, and chit chatting with Shawanda Hill and Morries Hall, then this was your pre-lunch entertainment.  He provided shite-all other than bullshite about “crowd aggression” which he couldn’t fucking see and didn’t alarm him enough to leave his beat with Hall and Hill. Next witness was Nicole McKenzie, MPD medical trainer who previously testified for the prosecution.  She explained the controversial excessive delerium notion cops love to use.  As pointed out previously, none of the symptoms applied to Floyd.  She said, on cross, that she wasn’t in the position to make a diagnosis — that was up to the ER doctor. Before starting with the Chauvin murder trial, I have some thoughts about the Daunte Wright murder.  Hennepin County ME, Dr. Andrew Baker, is back into another senseless cop murder case.  As many who have followed the trial remember, Dr. Baker said there are 5 causes of death an ME can choose to put in a Death Certificate according to the National Association of Medical Examiners (NAME):  natural, accidental, suicide, homicide, and undetermined.  The Hennepin County ME’s office wrote in homicide for Daunte Wright’s murder; not sad, unfortunate accident. Now to the case at hand — yesterday started with house cleaning matters: 1. Motion re: allowing Morries Hall’s statements in TX where he was arrested.  Judge Cahill took the matter under advisement and after lunch denied motion to allow statement testimony due to 5th amendment concerns.  2. Defense requested sequestration of jury because of the Duante Wright shooting.  Not a stupid request but denied.   First witness was cardiologist from Northwestern U. Hospital, Dr. Jonathan Rich.  Another expert who didn’t collect a fee — only payment for trial day because of time off from job.  He said this was his first time testifying but could have fooled me.  Brilliant in his detailed but accessible for the lay person descriptions of cardiology related matters.  Related beautifully via eye contact with the jury.  Solid on death due to subdual cardio-pulmonary failure. The afternoon started with poignant testimony from George’s younger brother, Philonise Floyd.  Not only did he speak to what a great brother and community man George was, he highlighted George’s closeness to their mother, Miss Cissy.  He put to bed one of the defense’s stupid arguments that Floyd was calling out to his girlfriend and not his mother when he cried, Momma, Philonise said George wailed that at his mother’s coffin — repeatedly.  A few very lovely family pictures of George. Finally, law professor Seth Stoughton whose specialty is LE, especially use of force issues.  He was a Tallahassee police officer/reserve for @ 5 years prior to going to law school.  I keep wanting to use the word, devastating when speaking of the prosecution’s witnesses, but he really was.  Defense attorney Nelson couldn’t lay a finger on him.  Stoughton frequently contradicted what Nelson was saying.   Except for the possibility of rebuttal witnesses after Nelson’s case in chief, the prosecution is finished with witness testimony and beyond a job well done.  Stellar.  This prosecution should be textbook material as to how to pick witnesses and in what order to present them. This morning we heard the testimony of Dr. Jonathan Rich, a cardiologist from Northwestern Univ. Hospital.  Incredible bona fides.  Dr. Rich didn’t take a fee for the many hours of review for the trial.  He volunteered because he thought he’d have something to contribute.  Boy Howdy did he ever!  He is paid $1200 to testify because of time off from work.  Ottery Scribe, in the comments, suggested that maybe that fee goes to the hospital.  The fee is dirt cheap for an expert of Dr. Rich’s caliber.   Dr. Rich said it was his first time testifying.  Could have fooled me.  He had excellent rapport with the entire courtroom and viewing audience.  He explained things in simple and not condescending terms whilst looking directly at the jury.  No question in his mind that Mr. Floyd died due to the 9 plus minutes of restraint in the prone position.  He cut down the suggestion it was due to heart disease or drugs.  He handled Nelson’s wacky hypotheticals easily — and repeatedly pointed out they were hypotheticals not facts from Mr. Floyd’s case. Nelson got nowhere.  Dr. Rich was unflappable.  Two witnesses in the afternoon and then the prosecution passes to the Defense.  The prosecution has the opportunity for rebuttal should it be necessary. 7:15 PDT.  Sometimes Judge Peter Cahill uses the morning time for some house cleaning regarding motions or matters yet to be resolved between attorneys or troublesome jurors (twice so far).  Last week ended with two more expert witnesses, adding to the excruciating and powerful body of evidence against Derek Chauvin who tortured and murdered George Floyd.  Forensic scientist, Dr. Lindsey Thomas, is the second witness who volunteered to testify, eschewing a fee.  The first was pulmonologist and critical care expert, Dr. Martin Tobin.  Dr. Thomas built on Dr. Tobin’s testimony and was unequivocal about cause of death, asphyxia caused by the pressure to his body.  Dr. Thomas was teacher and mentor to the Medical Examiner, Dr. Andrew Baker and they remain friends.  Defense Attorney Eric Nelson asked Dr. Thomas something to the effect:  If you removed the cops and the heart condition, and found Mr. Floyd in his apartment, could there be a finding that he died of a drug overdose?  Incredulity written on Dr. Thomas’s face was the least of her response.  Nelson is very fond of hypotheticals that have zero to do with the facts of this case. Dr. Baker was the second witness of the day.  Many, including me, thought he would be the defense’s best witness.  He was not.  Prosecution walked him through the Death Certificate.  Interesting factoid for me is that he only fills in cause and contributing causes of death.  Dr. Baker found the cause of death to be a homicide and contributing factors were coronary artery disease and drug use.   <blockquote> Under cross-examination, Baker agreed with Nelson's statement that Floyd's heart disease, narrowed arteries and drug use "played a role" in Floyd's death, but he testified that those things did not directly cause him to die. "Mr. Floyd's use of fentanyl did not cause the subdual or neck restraint," Baker said. "His heart disease did not cause the subdual or the neck restraint." . . . . "My opinion remains unchanged," Baker said as his testimony concluded. "It's what I put on the death certificate last June. That's cardiopulmonary arrest complicating law enforcement subdual, restraint and neck compression." "That was my top line then," he added. He held firm regarding the cause of death.   Nelson can call Baker back for direct testimony where he won’t be restricted to the questioning by the prosecution.  He said he planned to bring back the Minneapolis Police Department’s (MPD) medical trainer who testified for the prosecution. Cahill questioning one juror without audio/video.  Presumably from the press pool who were also present, the juror received a text from her mother about the defense and the judge asked if he/she were planning on writing a book about the case.  It seems the juror satisfied judge that it wasn’t grounds for dismissal from jury.  There are 2 alternates. This morning’s expert witness was Dr. Lindsey Thomas, forensic pathologist.  She had great presentation on top of her impressive expertise.  Dr. Thomas built very well on Dr. Martin Tobin’s testimony yesterday.  Her importance is that she addressed the autopsy report.  What the media has repeated is that the autopsy report is at odds with the prosecution’s position.  Her testimony put that to rest but we’ll see what happens.   Dr. Thomas knows the medical examiner, Dr. Baker very well — he was an intern under her instruction years ago.  They are still friends.  She hasn’t discussed the case with him. Defense Attorney Nelson spent most of his time on drugs, heart conditions, and confusing the witness. Dr. Thomas wasn’t off-putting or arrogant but seemed to be dealing with a particularly dull student or a reporter from Fox.   Prosecutor Blackwell cleaned up the mess. Yesterday was a demonstration as to the effect of not only a brilliant expert witness, but one who was charming, had good contact with the jurors, and without being surly, dismantled Defense Attorney Nelson’s cross examination and re-cross.  Some day I’ll use Mr. Google to find Nelson’s first name. [later: <a href="https://www.dailykos.com/comments/2025026/80689602#comment_80689602" target="_blank">alamancedem finds</a> it’s Eric.] Dr. Martin Tobin was stellar.  I did a short description in yesterday’s <a href="https://www.dailykos.com/stories/2021/4/8/2024981/-Liveblog-II-Day-9-of-the-Chauvin-Murder-Trial?utm_campaign=recent#comment_80686250" target="_blank" title="">Liveblog II: Day 9 of the Chauvin Murder Trial</a>.  Anyone who watched now has a major crush on him.  Positively brilliant.   Next was Daniel Isenschmidt, forensic toxicologist from NMS Labs in PA.  Same Lab a previous witness works, Susan Nieth (sp?).  I admit to zoning out.  I don’t do anything that involves graphs and numbers.  Mostly on the amounts of fentanyl and meth in Mr. Floyd’s blood — remarkably low levels when compared to living and dead DUIs with either or both drugs in their blood.  He remarked on the accuracy of testing hospital blood — taken shortly after death — as opposed to autopsy specimens.  Sorry, that’s about all I understood.  I did appreciate the witness’s correcting Nelson multiple times. Interim drama.  Nelson was flipping out about a packet of slides from the prosecution.  He claimed he didn’t get the updated packet and that he had spent more than a few nanoseconds on preparation using the outdated packet.  Prosecution said they sent the updated slides on April 6th.  Then he went into hyperventilation in a nanosecond over pdf files and other crazy stuff.  Judge Cahill, ever the moderating voice, was smoothing things over and said things can be straightened out.  Then Nelson declared it was his fault — Brownie Points for the admission and all was well in speed of light-land.  He has what appears to be a cold — losing his voice and wiping his nose with his fingers.  The lectern needs to be hosed down with Lysol. Last witness Dr. Bill Smock (flight deadline so testimony had to be done that day).  Worked at a Level One Trauma Center in Louisville.  Stated that the Hennepin Medical Center where Mr. Floyd was taken is also level one, meaning where you want to go with a traumatic injury.  Ages ago I remember a comparison between Washington D.C. and Baltimore regarding gun shot wounds and homicides.  B’more had more gunshot wounds but fewer deaths because of the level one University of Maryland Trauma Center. Dr. Smock now works as a police surgeon.  Very likeable, seemed to have good rapport with the jury, but no one ever again in the history of the world will be as perfect as Dr. Martin Tobin.  Dr. Smock was qualified as a witness.  He has a specialty in asphyxia from varying multiple means.  His opinion is that Mr. Floyd died of positional asphyxia.  His testimony was similar to Dr. Tobin’s by ruling out other possible causes.  He did go into “excited delerium” which is very controversial.  He explained there are reputable medical bodies (AMA, APA) who didn’t believe it was a thing but he does.  Important for the prosecution to present since the Defense really thinks it is a thing — like one of their many theories as to what killed Mr. Floyd.  Dr. Smock showed 10 manifestations of excited delerium and said you may have it if you display 6 of them.  He said Mr. Floyd displayed none. I had to attend to baby back ribs and am very grateful to zebz monkey for spontaneously taking expert control of the liveblog yesterday afternoon. Dr. Tobin’s charts and graphics which he had designed himself are remarkable.  The most striking one showed the three cops at one moment in time on top of Mr. Floyd — vehicle removed.  The graphic turned slowly 180 degrees.  Just stunningly effective. Dr. Tobin has excellent rapport with the jury, so much so, Nelson asked for a sidebar so he could object to Tobin asking the jury to use their own bodies to locate different spots on their necks.  Judge advised the jury that they didn’t have to if they didn’t want.  I’m guessing all couldn’t help themselves.  Same with calculating your own breathing.  The afternoon should be gripping — well gripping in the way you watch someone you can’t stand because she is a horrible carbon footprint walk around court with the back of her skirt stuck in her panty hose after leaving the loo.  So, that did happen.  Think Kelly Ann Conway, Kayleigh McEnany, Ronna McDaniel, Ivanka Trump, Ann Coulter — too many to choose from. <div class="table-wrapper"> <table align="center" class="basic-table" width="600"> <tbody> <tr> <td style="background-color: rgb(248, 248, 255); border-color: rgb(255, 110, 0);"> Liveblog updates from gchaucer2 on the ongoing trial session are found in the comment thread. Yesterday began with resuming the Prosecution’s direct questioning of LAPD expert witness Sgt. Stiger.  His conclusion was that Chauvin used excessive force.  He was pretty much in agreement with all of the Mpl. and MN State witnesses who addressed training and policy issues.  The Defense cross was all over the place, I can’t even capture it without a few shots of Jamesons and I’m not drinking right now.  This was Nelson’s first attempt at translating Mr. Floyd’s difficult to understand words as, “I ate too many drugs.”  Stiger said twice that he didn’t hear that.  Neither did I.  I didn’t know what he said at this point. On redirect and new to me, we discover that Officer Lane called in a Code 4 which means things are ok and suspect is in custody.  What that actually meant is that Chauvin and Thao should have taken a ride somewhere else.  I kept misspelling Officer Keong’s name.  It sounded like Kane to me.  Sloppy of me. Next witness Special Agent James Reyerson from MN Bureau of Criminal Apprehension (BCA).  They respond to questionable use of force cases.  New info:  BCA found an envelope with two $20 in the back of the squad car.  One assumes confiscated at some point from Floyd.  One bill was torn which coincides with the testimony of the Cup Foods’ clerk who said the woman in Floyd’s car ripped one and threw it out the window.   Nelson on cross brings up the “I ate too many drugs” routine.  First hearing, Reyerson says he couldn’t understand it.  With some prodding and a second hearing Reyerson agrees that is what Floyd said.  Ugh.  On redirect the Prosecutor played the audio in context with what the cops said and then Reyerson said it was “I ain’t do no drugs.”  Other commenters in the diary heard the latter.   I have a tin ear for languages, accents, dialects.  Nelson wasted an enormous amount of time on hypotheticals that have nothing to do with the case, a/c in a hybrid to explain the liquid — not urine — but that was clarified last week.  And something else I’ve thankfully forgotten. Next witness, MacKenzie (sp?) Anderson, BCA forensic scientist.  She checked the site, then, when the cars were towed to the lot, she checked the cars.  The first time was May 27, 2020 — then asked to check again in December 2020 at the request of the Defense through the AG’s office.  This was for pills and blood.  Pills contained fentanyl and meth.  No cross examination. Stiger of the LAPD.  Some have asked why this guy?  Isn’t there an in-state expert who could do the same thing?  Pretty much in-state LEOs already did expert testimony regarding the Mpl. and MPD policy and use of force training even though not certified as experts.  Some have pointed out that LAPD doesn’t have a great reputation — for me, all the more reason to listen to a cop from a department which thrived on excessive use of force.  Sgt. Stiger was very clear on reasonable use of force and force in this case was not reasonable .  Opinions vary which is what will be happening in the jury room I suspect.  Differing takes also adds to the interesting parts of the comment section.  On cross, Nelson was all over the place, lost his train of thought, never got back to Stiger’s report, was sloppy introducing exhibits and got nothing other than Stiger correcting/disagreeing with him multiple times. Second witness is Special Agent Reyerson who is in the excessive force investigation unit.  Lots of bona fide time — he was back and forth among state, corporate, and federal work.  Worked for the DEA in the task force against cartels.  In his 3rd year Doctorate Program, I believe in Education.  He has gone through testimony already provided about being called to City Hall to interview the cops, what he has reviewed, what he found — new evidence re: two $20 bills in an envelope in the trunk of the squad car.  Then sidebar, then lunch.  Drama!!  Thanks to all who have been commenting and we are lucky to have some seasoned attorneys who practice different areas of criminal law — an area I know nothing about.  I practiced Administrative Law and Appellate Procedure re: enviro issues for the most part.  My one case that involved a criminal element I encouraged the client to hire a criminal attorney — he got one of the best who was extremely kind and generous with me. Good afternoon all. The morning started with a Motion to Quash subpoena from the defense.  The subject of the subpoena is Morris Hall, one of the alleged drug dealers who allegedly supplied George Floyd with at least fentanyl and possibly heroin.  He was on video off site.  His lawyer, Attorney Cousins, did a good job re: her 5th Amendment argument. Judge Cahill asked Defense Attorney Nelson to provide some questions that didn’t involve the issues Attorney Cousins raised.  He proceeded to list all but one question that related to Attorney Cousins’ argument.  Sheesh. The only one the Judge latched on to was regards to Hall’s testifying to what he saw of Mr. Floyd’s demeanor in his vehicle.  Did he fall asleep?  Cousins argued that the statute for 3rd degree murder when it involves a chain of involvement with drugs that ends in a death is too broad and even that testimony could incriminate her client.   Prosecutor agreed but his argument focused more on the effect of Hall claiming the 5th on the jury.  We know juries are instructed not to construe anything about that but they do — and so do most of us.  This was followed by the concept of a blanket claim of the 5th which the judge said, as far as he knows, doesn’t exist in MN case law or statute.  He was impressively prepared and cited a number of cases in other State jurisdictions which didn’t accept blanket claims.  Ergo, the witness has to plead to individual questions.  Judge told Nelson to make a list of questions by Thurs.  Prosecutor was free to do the same and the Judge would revisit later. First witness was MPD Sgt. Ker Yang.  Crisis Intervention Coordinator.  Impressive background.  MA and PhD in psychology.  Basically went through the training program which is opposite of what Chauvin et al. did to Mr. Floyd.  I was new fridge interruptus so missed some of the testimony.  zebz monkey did a great job with details. Second witness was MPD Lieutenant Johnny Mercil.  Use of force trainer.  Personally trained in Brazilian jujitsu which uses body and leverage rather than punching and kicking.  He was the witness I thought Nelson made his best use of re: neck compression and prone position issues.  When I say, best, I mean not utterly terrible and embarrassing.  The angry crowd thing was a thing but Nelson kept using the picture of Chauvin looking blandly at the bystanders whilst his knee was on Mr. Floyd’s neck.  Good redirect to clean some stuff up. Good morning.  Today is Day 7 of the Chauvin Murder trial.  Short re-cap of yesterday’s proceedings.  The day started a bit early — judge questioned the jury off camera.  He came back to say the issue was an allegation of jury misconduct.  After questioning he was satisfied there was none. First witness was Dr. Bradford W. Langenfeld who was licensed in the summer of 2020, thus after the murder of George Floyd.  He was a resident when he received the body of the already dead Mr. Floyd.  He worked 30 minutes on attempting to resuscitate before calling the time of death.  He was an excellent witness.  Calm, precise, explained in both medical and layman’s terms and was unflappable under cross examination.   Next was the much anticipated star witness, Chief Mederia Arradondo.  Massive bona fides.  Testified that in no way was a knee on a person’s neck that long MPD policy or training.  In no way you leave a prone handcuffed behind the back in that position more than seconds, you roll them asap on their sides.  The defense’s  insulting him by pointing out he was long off the beat and held a position of “grandeur” didn’t flummox him — it only tarred Nelson, the defense attorney.  Brilliant witness. Last was MPD training expert Katie Blackwell (last name same as the lead prosecutor but not related).  Again, lengthy and impressive bona fides.  Besides law enforcement, she served in Iraq.  She was excellent in answering questions about restraint techniques.  When asked about Chauvin’s knee on the neck she said:  "I don't know what kind of improvised position that is. So that's not what we train."  Zing.  Very short useless cross examination. Good morning.  I hope all except Chauvin are rested up after a very stressful week of testimony.  Testimony from 3 teenage and one 9 year old witnesses was hard enough, but then there was the emotional testimony of Mr. McMillian who broke down sobbing, George Floyd’s girlfriend, Courtney Ross, and other shell shocked witnesses.  The week closed out with Lt. Richard Zimmerman, the <s>highest ranking</s> <a href="https://www.kare11.com/article/news/local/george-floyd/who-is-lt-richard-zimmerman/89-9e9b093b-2874-4689-b60a-b5b606e29da6" target="_blank" title="">longest-serving</a> (i.e. highest-ranking in terms of seniority) officer in Minneapolis. [-edit b.r.]  He slammed the door shut on whether or not Chauvin’s knee on the neck was appropriate restraint.  It was not — no way in hell. One and possibly the only, of today’s witnesses is Minneapolis Police Chief Medaria Arradondo who fired Chauvin and the other three cops who abetted murder.  According to James Hohmann of WaPo, there’s at least one Motion in Limine by the defense to restrict Arradondo’s testimony.  Motions in Limine are generally filed before the start of trial but can also be filed during trial but before particular testimony.  Motions in Limine are for the purpose of either precluding or sometimes including specific testimony.   <blockquote>  Stated in the most general terms, a proper motion in limine is an evidentiary motion that seeks a determination as to whether to exclude (or admit) evidence before it is offered at trial. Luce v. United States, 469 U.S. 38, 40 n.2 (1984) (A motion in limine is “any motion, whether made before or during trial, to exclude anticipated prejudicial evidence before the evidence is actually offered.”); Bradley v. Good morning.  Yesterday was a very traumatic period of emotional testimony.  Following upon Day One with Dispatcher Jena Scurry’s detailed review of the initial 911 call and what she saw on a screen in her department that caused her to worry enough to call her supervisor.  Second witness was the very powerful Donald Williams.  He was a witness as a bystander — meaning, he testifies to what he saw and not supposed to draw any conclusions.  He was also a witness who was an expert in martial arts and he could testify to what a blood choke hold is and what the effects are.  He could not testify to medical conclusions.  He provided emotional testimony regarding his feelings of despair over not being able to help George Floyd.   Second Day Donald Williams again took the stand.  His testimony was cut short the first day because of technical difficulties.  Defense counsel failed at painting him as an angry black man which Williams adeptly pointed out.  Next up were the three teenage and one 9 year old witnesses.  This girls were the most emotionally gripping.  They were followed by firefighter Genevieve Hansen who had a bit of a testy moment with the judge and defense counsel.  Judge reprimanded her outside of the hearing of the jury — but he didn’t know the cameras were still running.  Hansen is the first witness today and I believe it will be a continuation of the cross examination.  I’m guessing the Prosecutors talked to her about her demeanor and how to answer questions.  They will most likely do a re-direct. I missed his testimony yesterday.   Stand out impressions.  He, like all the prosecution witnesses was well prepared (even though he strayed the most).  Answered tersely to Defense questions.  Defense attorney Nelson tried too hard to show off about his newly discovered knowledge of Martial Arts and Williams continually corrected him. Best Williams comment of the day:  “You can’t paint me out to be angry.”  Oh, yeah. Defense Nelson didn’t help himself when he got testimony that Officer Thao prevented Williams from coming forward to help Floyd.  Thao put his hand on Williams’ chest.  Williams brushed it off (I didn’t want him touching me) and then stepped back on the curb.  All caught on camera.  Nelson quoted a bunch of increasingly pointed things, including swear words, that Williams yelled at the cops.  Still unhelpful as pretty much anyone could understand the provocation.  Just because swearing or just being mean to cops might become a crime in some dumbass states doesn’t mean that it is a crime. Nelson scored no points.  He gave Prosecutors the gift of the blatant racial bias re: painting both Floyd and Williams as the big angry black men.  Prosecutor Blackwell is brilliant at connecting dots. Teenage witness who was only referred to by her first name, Darnella, is the one who was courageous enough to film the viral 20 minutes of the nightmare.  She just turned 18.  During the pre-trial procedural discussions, Judge Peter Cahill said that 4 witnesses who either are or were juveniles at the time of the incident (aka murder of George Floyd) would not be shown on camera and would not have their full names given.  He knew the press already had and could print them.  WaPo has just referred to Darnella as teenage witness. Darnella was devastating as a witness.  She was completely overcome with emotion.  She said she has social anxiety so not prone to be a crowd heckler.  She confirmed nobody threatened the cops – that both Thao and Chauvin reached for their mace when anyone stepped off the curb (Williams) or got too loud.  People were shouting but didn’t physically threaten.  She said she feared Thao and Chauvin.   Defense Nelson made some unforced errors – like saying the area at the Cup Store wasn’t a neighborhood like those with houses.  Yoiks!  He got nowhere with Darnella other than looking like a floundering asshole. His last question was (paraphrased)  Your video went viral, did that change your life?  Darnella, tearfully, yes.   Blackwell on re-direct – asked her about how her life was changed.  She was still tearful.  She said she just thinks about her father, brothers, cousins, uncles (Black males) when she thinks of George Floyd.  She says she wakes up and apologizes to Floyd almost every day because she couldn’t help him.  Jeezus – she’s a kid.  Devastating. Next – Darnella’s little cousin.  Just 9 years old – 10 next week.  She sounded so wee tiny.  Just added corroboration of what she saw when she left the Cup Store.  Blackwell, for the second time, put up the closeup of the sociopath Chauvin as he’s kneeling on Floyd’s neck.  “Do you see this man in the courtroom?”  First she says no – the masks.  Somebody told Chauvin to take off his mask and he stood (not a good move) and the little girl identified him.  Smartly, no questions from the defense.
