In any courtroom in the United States, were the attorney for the accused be cited for misrepresenting evidence, lying to the jury and participating in the crime that his client was being tried for, a mistrial would be declared immediately with the attorney facing certain disbarment and possibly an indictment.
There is growing support for Adam Schiff and the House Managers to call for a mistrial in the impeachment trial of Donald Trump and a formal motion for such brought to the Senate floor for consideration.
Former Federal Prosecutor and MSNBC legal analyst Glenn Kirschner thinks this is exactly what should happen, citing that Pat Cipollone’s bad faith and possibly unethical participation in the very acts that led to the impeachment warrant such a motion.
This is exacerbated by the fact that Cipollone is White House legal counsel to the office of the Presidency. He is obligated to look out for our interests where such a conflict is evident. Taxpayers pay his salary. Trump may have found another Roy Cohn and we all paid for him.
The revelations coming from the New York Times late this week about Trump’s lead attorney’s involvement in meetings around the Ukraine plot to withhold funds would make him at least a witness and could crossover in to the role of coconspirator.
This argument was put forward by Mr. Kirschner over the weekend in an article on RAW STORY.
Though the motion to dismiss will certainly fail a Senate vote, presenting the argument for this remedy to such a monumental miscarriage of justice would at least provide some added transparency for a national audience. It further bolsters the evidence of how unfair a trail this is and how deep it all goes. “They were all in the loop”

Per comments. I understand that the motion won’t pass of course. It is to draw attention to more evidence of a corrupt conspiracy that extended to the White House Counsel who was representing Trump in the trial. This is a great opportunity to bring this up on the floor of the senate. The news coverage of this explosive action would be enlightening for the public.
